Master of Law of the People's Public Security University of China. Ten years of criminal investigation career, worked at a public security bureau in a certain municipality directly under the central government, involving multiple departments such as criminal investigation, economic investigation, intelligence, and legal system. I have guided and participated in the handling of a large number of general criminal cases and economic crime cases with significant social impact and complex cases, and have been awarded multiple times for meritorious service. After resigning from public office in 2017, he focused on criminal business and acted as an agent for multiple cases of significant social impact, including job-related crimes, economic crimes, and general criminal cases. The charge was changed to assisting in information network criminal activities, and the serious crime was changed to pleading guilty. The sentence was increased from the original more than ten years' imprisonment to one year and six months' imprisonment;
In Ordos City, Inner Mongolia, Li illegally occupied agricultural land and engaged in illegal mining. Li was arrested for illegal mining, and during the review and prosecution stage, he submitted a review opinion on the necessity of detention to the procuratorial organs, which was adopted. Li was released on bail on the last day. During the court trial stage, with two charges against him, the lawyer organized experts to argue and submitted favorable evidence, ultimately helping Li obtain probation;
In Xianning City, Hubei Province, the contract fraud case of Li's gang involved an amount of about 100 million yuan, which was audited. After multiple meetings with the lawyer, it was found that Feng obtained the relevant invoices in good faith, which should be an innocent case. The lawyer promptly fixed the evidence, grasped the main contradiction, formed a defense strategy, and submitted relevant evidence and defense opinions on not approving the arrest to the prosecutor's office during the review and approval stage, which was affirmed by the investigating prosecutor. Finally, the decision was made not to approve the arrest of Feng due to insufficient evidence;
Tao was suspected of fraud and was successfully not prosecuted. During the review and prosecution stage, significant flaws were discovered in the case handling process and main evidence through reviewing the case files. Defense opinions were communicated with the prosecution in advance, and the procuratorate made a decision not to prosecute due to insufficient evidence;
Yang is suspected of fraud and has successfully not been prosecuted. Qin was detained for fraud on the basis of a "routine loan gang" project. After accepting the commission, he met with Yang several times and found that he did not have the subjective intention to illegally occupy others' property. Although he was closely connected with the "routine loan gang", he had no criminal facts and did not participate in gang activities, so he should not continue to be detained as a suspect. After submitting a legal opinion on the necessity of detention during the investigation stage, Yang was recognized and released on bail pending trial. In the later stage of review and prosecution, after submitting a legal opinion not to prosecute, it was recognized and supported, and ultimately Yang successfully did not prosecute;
Cheng is suspected of theft and has successfully not been prosecuted. The defense opinions during the investigation stage were recognized by the prosecution and the arrest was not approved. During the review and prosecution stage, the prosecutor's office notified Cheng by phone to prepare for prosecution. After reviewing the main evidence of the curly hair case and fully communicating with the prosecutor's office, the legal opinion was recognized by the prosecutor and a decision not to prosecute was made the next day;
Zhang is suspected of theft and has successfully not been prosecuted. Zhang was criminally detained on suspicion of burglary. After accepting the commission, it was discovered that there were significant flaws in the evidence. After submitting a legal opinion to the prosecutor's office not to approve the arrest, it was recognized and a decision was made not to approve the arrest due to insufficient evidence. Later, Zhang was not prosecuted;
Luo was suspected of rape and was successfully not arrested. Luo was keeping a mistress outside and had a conflict of interest with her.
